Police Fitness Test Discriminated Against Women, Federal Judge Rules

A federal judge has ruled that fitness tests that women cannot pass at the same rate as men are a violation of federal law.

Judge Richard Matsch was born in 1930! He presided over the Oklahama City bombing case that saw Timothy McVeigh convicted in a trial that covered up a great deal of the truth.

At age 87, Matsch is still ruling from the bench. He’s now found that fitness tests that women can’t pass are discriminatory.

The test isn’t described in the story, but I probably couldn’t pass it either, but I’m not selfish enough to demand that standards be lowered for my benefit.

Putting unqualified women cops on the street is going to kill people. Matsch needs to retire and let someone with a stronger sense of logic rule from the bench.

A fitness test given to Colorado Springs police officers discriminated against women and violated civil rights laws, a federal judge ruled Wednesday in a two-year lawsuit.

The test “shamed and ostracized” the 12 plaintiffs – many of them decorated officers with decades of service – while providing “meaningless” results, ruled U.S. District Judge Richard Matsch.

Performing poorly on the test left officers at risk of losing their jobs, despite the benchmark scores being “arbitrary” and the evaluation having little to do with the officers’ everyday work, Matsch said. Significantly more women than men failed it.

“To retroactively impose that requirement on women who have invested their lives as career police officers is fundamentally unfair,” Matsch wrote.

The ruling that Colorado Springs violated Title VII of the Civil Rights Act of 1964 leaves the city on the hook for a possible payout to the plaintiffs for wage loss and emotional distress. A hearing on damages is expected to be set in the coming week.

A California civil rights advocate said it also sends a message to municipalities across the nation to avoid such fitness tests for potential hires and veteran employees.

“If municipalities are going to use tests like this, they have to make sure there’s a scientific basis behind them,” said Jocelyn Larkin, executive director of the Impact Fund. The organization helps bankroll civil-rights lawsuits, and it contributed $30,000 to this case.

Donna Dell’Olio, an attorney representing the women, praised the ruling as a victory for women seeking to join the force.

“The women are wonderful professionals, and all they wanted was to be able to serve crime victims and the citizens of Colorado Springs,” Dell’Olio said. “And now they’re going to be allowed to do that.”

Ten of the dozen plaintiffs remain on the force, Dell’Olio said. One has since moved to Wyoming, and another left the department amid fears she’d lose her job for failing the test.

“They did this at great peril to their careers,” Dell’Olio said. “And they did it for the younger women who are coming up behind them.”

A statement from the Police Department said “the city has received the ruling, is reviewing it, and evaluating the city’s options.”

The issue dates to 2009, when former Chief Richard Myers mandated all officers undergo fitness tests, and the department hired Human Performance Systems of Beltsville, Md., to create the evaluations. They included one-minute sit-up and push-up tests, as well as two running tests, one of which focused on agility.

Practice tests in 2013 showed deep disparities in women’s and men’s success rates, the lawsuit said.

Forty percent of women failed the test, compared with 9 percent of men. Women police recruits tested that year fared slightly worse, while men did slightly better.

Still, a 2014 order by Myers’ successor, Chief Pete Carey, mandated each officer pass the test annually. Officers who failed the first test were relegated to desk duty, while those who failed after six months of trying could be fired.

All 12 plaintiffs failed on the first try, including Maggie Santos, a lieutenant at the time overseeing the department’s Internal Affairs division.

She retired after 24 years in the department, taking a job as director of campus safety at a college. In leaving early, Santos said Wednesday that she left “significant” pension benefits on the table.

The risk of being fired without a place to go was too great, she said, especially as her kids neared college.

“It was horrible,” Santos said. “I didn’t want to leave. That isn’t when I had planned to retire. I still had more career in front of me, and it was taken.”

In issuing his ruling, Matsch relied on complex statistical analyses highlighting the disparities women faced.

He said some of the evaluations – such as the push-up test – favored men while “not being designed to evaluate an officer’s overall suitability for duty.”

The Police Department also erred in making the test a sole criterion for an officer’s firing, rather than as “one component,” he said.

In the process, Matsch noted that the Police Department’s use of a fitness test for current employees – not applicants – was unprecedented.

Santos said Matsch’s ruling was bittersweet.

“The reason why we did it was for the younger women,” Santos said. “They won’t appreciate it now when they’re in their 20s, but in 20 to 25 years, they’ll appreciate what we did, and we’re doing it for them.”

Mikaela Kellner, arguably Sweden’s most famous police officer, has quit her job after eleven years on the force. Kellner rose to international fame last summer for arresting a thief wearing only a bikini. Her resignation may strike a blow to the public image of Sweden’s police, which has suffered recently.

In 2015, Mikaela Kellner made international headlines and was dubbed ‘Bikini police’ and ‘Swedish ninja’ for assisting in the arrest of a thief in a park in Stockholm while off-duty. The fact that she was wearing a bikini instead of her police uniform did not stop her from intervening and pinning the bewildered would-be pickpocket to the ground.

She’s muscular because she works out, including lifting weights.

Kellner’s bikini feat was hailed by strangers, colleagues and friends alike, and the fearless policewoman quickly rose to national fame, which culminated in a call from Swedish Interior Minister Anders Ygeman and an invitation to have lunch at Rosenbad, Sweden’s seat of government.

However, the supportive publicity did not prevent Mikaela from quitting.

“The main reason is that I’ve not felt comfortable with the recent [police] reorganization. I do not think that personnel are being treated fairly, as they should,” a dismayed Mikaela Kellner told the Swedish tabloid newspaper Expressen. Kellner explained that she became weary of her job as a police officer after eleven years in uniform. However, she admitted that it had been a hard choice.

“[Being a police officer] has become a bit like a second identity, and I feel bad about not doing a good job,” Kellner told Expressen.

She started with taking a year’s leave to ponder future options. For now, she intends to focus more on her work as a personal trainer.

Given the nonwhite invasion of Sweden by parasitic scum, the country is going to miss having a strong woman police officer out there pushing the Muzzies around when they think they can take on a woman and easily win.

Good luck to Mikaela in her new career and good luck to Sweden, especially to all Swedish women.

From what we know, Pastor Terence Crutcher was the proverbial “good black man.” Nonetheless, he was shot dead by a policewoman, apparently after his car stalled in the middle of the road.

Take a look and see if you agree with me that this case has the potential to explode into a nationalization of police forces around the USA. This could be the big one that Hillary and Obama latch onto in order to promote a different kind of policing than the world has ever seen before.

There is also a distinct possibility of a heightening of racial tensions in America. I expect that black football players at all levels will be using this shooting to engage in more protests. Obama’s Department of Justice has already rushed to the scene. What other protests emerge are unclear, but this case has a huge amount of potential to bring fundamental change to law enforcement.

The U.S. Department of Justice has opened an investigation into whether a civil rights violation occurred during the fatal police shooting of an unarmed man on Friday night.

During a Monday afternoon news conference about the death of 40-year-old Terence Crutcher, Tulsa Police Chief Chuck Jordan said officers found no gun on Crutcher or in his SUV, which was stopped in the middle of 36th Street North just west of Lewis Avenue.

Officer Betty Shelby fired a single shot at close range that video footage released Monday indicates hit Crutcher in the upper right chest. Another officer, Tyler Turnbough, deployed his Taser at almost the same time Shelby — who did not have a Taser — used her service weapon.

“I want to assure our community, and I want to assure all of you and people across the nation who are going to be looking at this, we will achieve justice, period,” Jordan said.

Chief of Police Jordan is white.

As reported by Heavy.com Officer Shelby’s husband, also a cop, was in the police helicopter circling overhead when the shooting went down.

Whatever set him off, he deserves the three year prison sentence he’s received.

Trying to decipher the deeper meaning of what we see, I conclude that women police officers are problematic. It’s not about whether a person was born with a penis or a vagina. What matters in policing is size and strength. Many men are too small, too short, or too lacking in muscles to be effective cops. Almost all women are.

So what the hell are they doing on the street? Endangering themselves and others.

Politicizing policing? It’s the Marxist/feminist way.

Craig Radbourne, 25, of Stanmore Gardens, Newport Pagnell, Buckinghamshire, pleaded guilty to a charge of assault causing actual bodily harm and was sentenced at Winchester Crown Court to three years in prison.

A Washington state police detective is facing charges of sexual misconduct with a minor after she allegedly had sex with a 17-year-old she met while working as a resource officer at a high school.

The relationship between Det. Dione Thompson and the transgender teen began in 2010, according to KiroTV, when the then-17-year-old was a student at Bothell High School and continued until February 2011.

The 45-year-old reportedly had sexual encounters with the former student in her patrol car at a library and outside of a restaurant, Seattle PI reports.

The teenager was living as a woman when Thomas first met him, but now identifies as a man. Dione allegedly even moved the teen into the home she shared with her girlfriend.

According to court documents, the relationship began with Thompson contacting the former student on Facebook and the two soon began seeing each other outside of school.

At the time, the former student identified as a female and court records state that Thompson persuaded him to live in the home Thompson shared with her partner at a time when he was facing ‘a lot of turmoil’ personally.

He reportedly lived with Thompson for a long period of time and the two continued the sexual relationship, according to KOMO news.
